Walk Booking Terms & Conditions

Key Points:

You enter into a booking with us when we issue our confirmation email. If you then cancel, there will be cancellation charges. Initially this may only be a deposit but can go up to 100%.of the cost of your walk.

In making a booking you confirm that you agree to all terms and conditions.

You can make changes to your booking in certain circumstances, but we may not be able to agree to the change, if so the cancellation policy will apply. We make no charge for this. We can change and cancel your booking. We will not pay you compensation in any circumstances.

We are responsible to you for providing your walk but there are legal limits.

You must ensure that you are aware of, and fit for, the nature and demands of the walk activities and arrangements.

You are responsible for any insurance required to join and participate in our walks. Whilst the Market Bosworth Society has Public Liability Cover (details available upon request) you are responsible for your own insurance requirements.

1 Our details

Your package walk booking is with the Market Bosworth Society (MBS) When you make a booking you enter into a contract with MBS. 2 Your walk booking

A booking will exist as soon as we issue our confirmation email. This booking is made on the terms of these Booking Conditions. When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these Booking Conditions. No member or representative of MBS other than a Chairman or Vice Chairman has authority to vary or omit any of these terms. No promise of a price reduction or refund will be binding on us unless confirmed by us in writing.

3 Walk price

Prices shown in our brochure and website are based on one person taking part in one of the offered or negotiated walks. We reserve the right to alter the prices of any of the walks shown in our brochure. You will be advised of the current price of the walk via the website.
Mistakes or computer errors occasionally occur, so if any price in our brochure, on our website or booking system is obviously wrong then any booking made based on that price won’t be valid and we will be entitled to cancel it and give you a full refund unless you wish to pay the correct price.
Please also see clause 8(a) below on changes to the walk price.

4 Paying for your walk

When you make your booking, you must pay a deposit of £3 per person for walks 1 to 5. For bespoke walks the deposit will be £5.00 per person Deposits are non-refundable the balance of the price of your walk must be paid upon arrival at the setting off point as notified in our confirmation email. If not paid in time, we shall cancel your walk arrangements. If the balance is not paid in time we shall retain your deposit. Our confirmation email will confirm the exact amount of the deposit.

5 If you cancel your walk

You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking received at our offices. Since we incur costs in cancelling your travel arrangements, you will have to pay cancellation charges as follows (see also the exception below):

In all cases Deposit Paid.

Note: If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.

6 If you change your booking

If, after our confirmation email has been issued, you wish to change your walk arrangements in any way, for example your chosen date, we will do our utmost to make these changes, but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. You will not be asked to pay an administration charge You can transfer your walk booking to another person or persons, who satisfies all the conditions that apply to this booking, by giving us notice in writing at least 7 days before the walk date. Both you and the new walker(s) are responsible for paying all costs we incur in making the transfer.

7 If we cancel your booking

We reserve the right to cancel your booking. We may cancel your booking if the minimum number required for the walk to go ahead is not reached (usually 10 participants). We will not cancel less than 8 days before your walk date. except for unavoidable and extraordinary circumstances, or failure by you to pay the final balance.
Unavoidable and extraordinary circumstances means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.
If your walk is cancelled you can either have a refund of all monies paid or accept an alternative walk of comparable standard from us if we offer one (we will refund any price difference if the alternative is of a lower value).
In the event a refund is paid to you, we will:

provide a full refund.

We will not pay compensation under any circumstances.

This does not exclude you from claiming more if you are entitled to do so.

8 If we change your booking

(a) Changes to the walk price. Once the confirmation email has been sent by us and received by you we will not change your walk price.

 

(b) Changes other than the price

It is a term of your booking that we are able to make changes to any aspect of your booking. If the change is insignificant we will not notify you, otherwise we will ensure that you are notified about it.

We will contact you and you will have the choice of accepting the change or having a refund of all monies paid. You can also accept an alternative walk, where we offer one (we will refund any price difference if the alternative is of a lower value). We will tell you the procedure for making your choice. Please read any notification of changes carefully and respond promptly as if you do not respond to us within the timescale given your booking may be cancelled.

If you choose to accept a refund:
We will not pay compensation

The compensation that we offer does not exclude you from claiming more if you are entitled to do so.

9 Our liability to you

You must inform us without undue delay of any failure to arrive at the start point at the agreed and notified time, you may be entitled to an appropriate price reduction. We will not be liable where any failure to arrive at the notified setting off point at the allotted time. or unavoidable.

10 Protecting your money

We provide full financial protection for our walks and your deposit.

11 Complaints

If you have a complaint about any of the services included in your walk, you must inform our walk leader without undue delay who will endeavour to put things right. If it is not resolved locally, please follow this up within 28 days of your return home by writing to Chairman, Market Bosworth Society, c/o 29 Warwick Lane, Market Bosworth, Leicestershire CV13 0JU, United Kingdom giving your walk booking date, together with the date you received the confirmation email and all other relevant information. Please keep your letter concise and to the point. If you fail to follow the requirement to report your complaint on your walk, we will have been deprived of the opportunity to investigate and rectify it and this may affect your rights under this booking.

12 Additional assistance

If you are in difficulty whilst on your walk and ask us to help we will provide appropriate assistance, in particular by providing information on health services, local authorities; and helping you to find alternative arrangements and any necessary phone calls/emails. You must pay any costs we incur, if the difficulty is your fault. The booking person remains responsible for any vulnerable walkers.

13 Passport, Visa, and Immigration requirements

Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel to the UK because you have not complied with any passport, visa, or immigration requirements.

14 Fitness

Bookings are accepted on condition that participants are physically and mentally fit, and able to cope with the demands of the walk without assistance from our walk leader or other party member. It is your responsibility to ensure that you and your party are aware of the nature and demands of the holiday arrangements before booking. Please set out any questions you may have on your booking form under “Other Information” and we will do our best to provide the information you require.
We reserve the right to exclude you from individual walks or activities or from the walking and activity programme as a whole if in the reasonable opinion of our tour leader the demands of the walk would be detrimental to the interests or safety of you or the group as a whole. In the event that our tour leader deems such a decision is necessary we will not be liable for any additional costs incurred or to provide any refund for missed activities. We also reserve the right to refuse any booking for a walk where we are not satisfied that the applicant’s health, fitness or experience is appropriate to the walk selected.
Should you suffer from a mobility impairment, disability or medical condition relevant to your participation in the walk arrangements this must be declared to us (in addition to any declaration made for your insurance purposes to any other third party) at or before the time of booking. You must advise us of any impairment, medical condition or disability which may affect your active participation in the walk arrangements develops after your booking has been confirmed. If we feel that we cannot meet your needs, we reserve the right to decline or cancel your booking.
In the event of illness or injury relating to you or your party, we may make such arrangements as we see fit and recover the costs thereof from you.

15 Participation and personal responsibility

When you book your walk with us, you accept responsibility for the proper conduct of all members of your party during your walk. Bookings can only be accepted from persons under18 years of age when accompanied by an adult who will be responsible for them and accompany them on all walking activities. You agree to accept the authority and decisions of our staff, walk leaders and local partners whilst on any walk with us. If in the reasonable opinion of any such person(s) or any other person in a position of authority (such as, for example, a venue owner or employee), your health, mobility, level of fitness or conduct at any time before or during a walk is endangering or appears likely to endanger your health or wellbeing or any third party (including any other walkers or walk group members) or the safe, comfortable or happy progress of the walk, you may be excluded from all or part of the walk.

In such circumstances full cancellation charges will apply and no refund will be given.
Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation and return travel arrangements) you may incur as a result of your walk arrangements being terminated.
If you cause damage during the walk you must fully reimburse the owner or supplier For the cost of the damage before the end of your walk if the cost has been established by then or as soon as it has been established if later. You must indemnify us for the full amount of any claim (including legal costs) made against us by the injured party or any third party as a result. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other party’s full legal costs) as a result of your actions.
You must comply with a non-smoking policy whilst walking, when dining, alone or as a part of a group, during group walks.

16 Insurance

It is a term of booking that you obtain adequate travel insurance to undertake the walk (except for UK residents walking within the UK mainland) by the date your walk arrangements commence.. No refunds will be made should you be excluded from the walking programme through being uninsured or you are unable to demonstrate that you are insured.

17 Excursions

Excursions or other tours that you may choose to book or pay for whilst you are on walk are not part of your walk provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator. We are not responsible for any travel arranges unless we have agreed to them in writing after your booking but prior to the walk commencing.

18 Travel agents

We do not offer any of our services or walks via a travel agent unless specifically explained on the booking form. Request from travel agents or similar will not receive a response and will not be booked. Any monies paid to any agent (unless agreed to us in writing prior to the booking for a walk being made are not our responsibility and under no circumstances will a refund be considered or provided,

19 Law and authority

This booking of your walk is governed by English Law, and the authority of the English Courts. You may however choose the law and authority of Scotland or Northern Ireland if you live there and wish to do so. Should you choose the law and authority of Scotland or Northern Ireland you will be responsible for all costs incurred by the Market Bosworth Society and its representatives, including travel and accommodation costs and loss of income costs if appropriate.

20 Validity

These booking walk conditions, published on 1st March 2019, supersede all previous versions.

21 In the case of disputes

Should any dispute arise we will do our best to resolve them amicably. In all cases the decision of the Market Bosworth Society Committee is binding and final. Your statutory rights are not affected.

Your Personal Data and MARKET BOSWORTH SOCIETY

Your confidentiality is protected by the Data Protection Act and, from 25 May 2018, the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) and the Privacy and Electronic Communications Regulations 2016 (PECR). Any personal information supplied by you to Market Bosworth Society will be kept on file. Market Bosworth Society will always store your personal details securely and delete them once they are no longer relevant or when requested by you. A record of members’ and non-members contact details may be kept for historical purposes. You may request the Market Bosworth Society to delete your details by contacting the Society via walk-bosworth@marketbosworthsociety.com and confirming your identity.

When you fill in a Booking Form you are asked to provide Market Bosworth Society with some Personal Data. This data will be used by the Market Bosworth Society to communicate with you. You can opt out of our communications at any time by contacting the Market Bosworth Society as described above..

We will use the data to provide the service that you expect and will communicate with you as you have agreed to. The data we hold will be used to send you information which may be relevant to your booking at our discretion, to make you aware of any offers and to communicate with you as necessary.

Market Bosworth Society will only allow your information to be used for Market Bosworth Society purposes and others working on our behalf and will only share this information if required to do so by law. We will never share your information with other companies, individuals or charities for marketing or any other purposes. Should a third party ask for your details you will be provided with enquirers details for you to initiate contact, if desired.

You have the right of access to a copy of the information Market Bosworth Society holds about you (a subject access request) obtainable subject to proof of identity from Market Bosworth society via the walk-bosworth@marketbosworthsociety.com or by writing to Chairman, Market Bosworth Society, c/0 29 Warwick Lane, Market Bosworth, Leicestershire.
